Terms & Conditions :

It is understood that the following terms and conditions are a fundamental component of this agreement and that no changes to it can be made without the written consent of Huma Photography (also known as “Mirrorless Photography Studio” or “Huma photographer(s)”). You are bound by the terms and conditions outlined below by scheduling and paying for your session at Mirrorless Photography Studio. All photographers and staff members of Mirrorless Photography Studio are collectively called the “Studio,” as is the company as a whole. The term “Client” refers to the client or clients and any additional people present during a photo shoot with any Mirrorless Photography Studio photographers.

Child Safety Responsibility

Parents/Guardians must understand that they are solely responsible for the safety and well-being of their child. 

By reading this, parents/guardians acknowledge and agree to assume responsibility for the health and safety of their child during the photoshoot. They understand and agree to the following terms and conditions:

1. I, the parent/guardian, have read and understood the Safety Policy provided by the photographer.

2. I will inform the photographer of any known allergies, sensitivities, or medical conditions, physical or mental, that my child may have, including food allergies, skin sensitivities, or other relevant information.

3. I will ensure that my child is dressed appropriately for the photo shoot, considering the temperature and comfort of the location.

4. I will be present throughout the photoshoot to supervise and support my child.

5. I will follow any instructions or guidelines the photographer provided regarding my child’s safety and well-being.

6. I will inform the photographer immediately if my child appears uncomfortable, distressed, or unwell during the photoshoot. I will prioritize their needs and well-being over capturing the perfect shot.

7. I understand that the photographer will take reasonable precautions to ensure my child’s safety but cannot be held liable/responsible for any accidents, injuries, or health issues that may occur during the photoshoot.

8. I now release the photographer from any liability, claims, or damages related to the photo shoot.

By this, I acknowledge that I have read, understood, and agreed to the terms and conditions outlined in this safety policy.

Payment Terms:

A non-refundable Deposit of the Session Fee is payable for booking & reservation. Original photographs are released after clearance of the total outstanding items.

Cancellation Policy :

If the customer cancels the shoot for any valid reason, a credit voucher for the deposit amount will be granted. This voucher can be used for any session with us and is valid for six months.

Postponement:

The Studio will accommodate rescheduled sessions once. Any such changes must be communicated verbally to the studio at least six days before the shoot date so that any required adjustments may be made and time slots can be allocated to clients on the waitlist. The studio will facilitate the session on the date based on the client’s request, subject to Studio/photographer availability.

So that you know, the deposit will be forfeited if a customer doesn’t cancel or show up for the reservation.

Exclusive Photographer:

The client or anyone who comes with the client cannot take photographs during sessions in the studio or outdoors. The studio’s qualified photographer will carry out all sessions.

Rights for Personal Usage Only:

All captured images are still the Studio’s property. The Client can print copies of the Studio’s photos for non-commercial use and give them to friends and family. Images may be used on individual websites as long as a copyright notice identifying the studio and the photographer is present following the photos. The client needs help selling the pictures or entering them into a competition. Commercial and corporate clients must notify the studio for clearance if images are used commercially.

Intellectual Property (Copyright, amongst others):

The studio is free to display and utilize the photos it has taken for advertising, display, website and internet promotion, photo competitions,  studio displays, all digital marketing platforms, and any other use it deems appropriate for promoting its products and services. Unless the Client has made a written request for privacy before the Shoot, in which case the Studio may not use such photos of the Client for publicity, promotion, or presentation purposes, the Client releases the Studio and its legal representatives and assigns from all claims and liability relating to said photographs. If photographs of the Client who has requested privacy are used before said public usage, the Studio is released from all claims and liability relating to said photographs.

Weather contingency:

If an outdoor session is canceled due to inclement weather, a studio session will be substituted, and any difference in package prices will not be refunded.

Inherent Qualities: 

Client understands that color dyes in photographs and other print media may fade or discolor over time due to the inherent characteristics of dyes and environmental factors that may deteriorate due to delamination and oxidation, and Client releases the Studio from any liability for claims of any kind based upon the deterioration due to such inherent characteristics.

Non-guarantee:

Although every effort will be made to capture images of all significant and unique occurrences throughout the Shoot, the Photographer cannot guarantee those mentioned above. The Studio disclaims all liability for any damaged photos caused by inclement weather, people refusing to cooperate during the Shoot, or other circumstances beyond the Studio’s reasonable control.

Privacy Policy & Data Collection:

The data controller, Studio, collects your personal information in compliance with Industry. An asterisk denotes all mandatory fields. You can only process your request if all required fields are filled in. I’ve gathered your personal information to fulfill your request. You have the right to view, modify, and delete your data. You also have the right to object to or restrict how your data is processed.

Miscellany: 

These Terms and Conditions contain the complete agreement between the parties. So that you know – any changes will be shared here and made public. Any waiver of a breach or default hereunder would not be a waiver of any subsequent breach or default hereunder or under any other agreement. Before the booking deposit is paid, we must agree on any differences or revisions in writing.
